ERNEST BESIG, being first duly sworn, deposes and says:
That he is the director of the Northern California branch of the Amri-
can Civil Liberties Union, Located at 216 Pine Street, San Francisco, a national
non-profit, non-partisan, non-sectarian organization, whose purpose is to protect
and defend fundamental American Civil Liberties, particularly as guaranteed in
the Bill of Rights, wherever, whenever and by whomsoever attacked;
That the above-entitled action will not only determine the rights and
peivileges of the petitioner and other persons of dapanese anwostry, but at the
same time raises grave questions of civil liberties affecting all persons wihtin
the United States;
Therefore, your offiant asks leave to file a brief as amicus curiae on
or before the 20th day of July, 1942, in order to express the views of the Nor-
thern California Branch of the American Civil Liberities Union with reference to
the issues involved.
Copies of this affidavit are being served upon counsel for the parties
herein.
